Conservatives Vow To Defy Court
Conservatives say they’ll keep fighting against gay marriage and will defy the court.
According to Talking Points Memo, 2016 Republican presidential candidate Mike Huckabee openly defied the court ruling, which he deemed, “unconstitutional.”
Huckabee also said:
The Supreme Court has spoken with a very divided voice on something only the Supreme Being can do-redefine marriage. I will not acquiesce to an imperial court any more than our Founders acquiesced to an imperial British monarch. We must resist and reject judicial tyranny, not retreat.
RawStory.com reports that Republican Senator Ted Cruz of Texas told Sean Hannity’s radio show:
On marriage, I’ve introduced a constitutional amendment that would protect the authority of state legislatures to define marriage as the union of one man and one woman. We should pass that amendment. I’ve also introduced legislation stripping the federal courts of jurisdiction over legal assaults on marriage.
However, the Supremacy Clause in the U.S. Constitution grants federal authority over the states.
Roy Moore, the Chief Justice of the Alabama Supreme Court, shared a posting by his wife Kayla on Facebook by The Foundation for Moral Law that states:
Not only does the U.S. Supreme Court have no legal authority to redefine marriage, but also at least 2 members of the Court’s majority opinion were under a legal duty to recuse and refrain from voting. Their failure to recuse calls into question the validity of this decision.

You’re perfectly free to criticize, castigate, insult and argue against the Supreme Court, for any of its opinions. You are NOT free to “defy” a ruling, without having to face some consequence. If Mr. Huckabee were to become President and ordered the federal government not to protect the rights of gays to marry, he’d be in violation of the law and of his oath to uphold and defend the Constitution. When the Supreme Court rules on the constitutionality of something, that opinion stops being an opinion and becomes part of Constitutional law. The only ways to overturn it, at that point, are to have the Supreme Court reverse the ruling, or have Congress or the States pass a Constitutional Amendment.

Huckabee only introduced this amendment because he knows it won’t pass, and because it will make him look “tough.” The fact of the matter is that anyone who opposes gay marriage on a state level is a bully, and bullies are always the first ones to claim to be the victims.

Erm, I’m confused- aren’t conservatives always banging on about lawlessness and reminding liberals that there is NO justification for it? What about that handy conservative trope-“respect for law and order”( shades of Barry Goldwater and Richard Nixon)-or do conservatives only respect the laws that reflect their own personal prejudices- and to hell with the rest??? Please clarify- I for one am definitely confused!
