Court rules Trump’s travel ban remains blocked

President Donald Trump’s travel ban will remain blocked, a federal appeals court ruled Thursday.

The ruling means that citizens of seven majority Muslim countries will continue to be able to travel to the US, despite Trump’s executive order from last month.
The order bars citizens of Iraq, Syria, Iran, Libya, Somalia, Sudan and Yemen from entering the US for 90 days, all refugees for 120 days and indefinitely halts refugees from Syria.
Trump issued the travel ban on January 27, causing chaos, confusion and protests at international airports as the legal status of people in transition was suddenly thrown into question. Lawsuits have been filed across the country, but it was one from federal Judge James Robart in Seattle last Friday that blocked the travel ban nationwide, clearing the way for resumed travel from the seven countries.

All three judges agree, it was unconstitutional…
    On to the USSC.

they should be granted immediate citizenship if they so desire.

undocumented workers should be given immediate amnesty and granted immediate citizenship if they so desire.

the congress of the United States MUST make America a shining beacon of hope to the world again -with or without the approval of the SELECTED executive branch whose leader LOST the popular vote by 3,000,000 to Lady Clinton.

the orange blob has NO MANDATE from the people, he NEVER did.

neither should he receive a mandate from the representatives of the people.

tRump is going to be a mad bully and will want a target he can bully around. Look for him to do something mean and stupid at Standing Rock to the DAPL pipeline protesters. Things might quickly escalate out of control this weekend. Everybody, be prepared for the unexpected.

    • whatthe46 February 9th, 2017 at 20:09

i’m so afraid for them. this is why he shouldn’t have been allowed to take an oath until he divested. he has money in DAPL and he’s pitching a bitch and threatening nordstrom because they dropped ivanko. this POS is a maniac.

It was 5 years before the Courts struck down an executive action by President Obama when he made recess appointments to the National Labor Relations Board.

It was 3 weeks for Dear Leader Trump. Now let us do our best to make sure that the remaining timeline of his presence in the Oval Office is similarly accelerated. I do not refer to the thing in the Oval Office as “president”, but I would be overjoyed to refer to him as Former President by December of this year.

Remember boys and girls, nothing in the Constitution requires articles of impeachment to be based on statutory crimes. The word “misdemeanor” appears in Article II, Section 4 but it does not necessarily mean a defined criminal act. It can refer to a minor non-criminal act.

The articles of impeachment against Andrew Johnson included a charge of making speeches that were disrespectful to Congress. So all you Trump worshipers thinking that your Dear Leader is safe as long as he has not been found to actually violate a law, could be in for a bigly disappointment. I can only hope….

9th Circuit Court of Appeals rules Trump a Constitutionally ignorant, bigoted islamophobic Twitt-troll!

    • arc99 February 9th, 2017 at 18:56

For icing on the cake, it would be perfect if they appealed to the SCOTUS and they simply declined to hear the case. The unanimous 9th circuit verdict would be final with a big explanation point shoved right up Trump’s you-know-what…

      • mea_mark February 9th, 2017 at 19:00

Actually it goes back to district court for full trial. Of course by the time that happens, the temporary EO will be over. #DERP45 will have, wait for it, derped.

I believe the proper term is “judicial butt-plug”.

      • The Original Just Me February 10th, 2017 at 05:35

This only maintains the stay. The case will now go back to the Judge in Washington State to be Judged before a Jury.

    • dave-dr-gonzo February 9th, 2017 at 19:26

… and that was the nice part of the ruling!

The National Weather Service has just issued a winter tweetstorm warning for the entire country, with the epicenter at 1600 Pennsylvania Ave. Conditions are expected to be severe.

According to NPR he tweeted in all caps SEE YOU IN COURT. I thought that’s where they just were.

    • Suzanne McFly February 9th, 2017 at 19:09

Amazing that he doesn’t know what a court is when he has been in them multiple times. Well he sent his lawyers to them at least.

      • Larry Schmitt February 9th, 2017 at 19:10

Actually, he has probably never personally appeared. That’s what lawyers are for.

        • Suzanne McFly February 9th, 2017 at 19:19

As much TV he watches, he has had to come across Judge Judy a couple times you would think.

  9. Larry Schmitt February 9th, 2017 at 19:09

Wow. The story on Wash Post is only 25 minutes old, and it already has over 2,000 comments. Here’s the best of the early comments: “Someone has to read the decision to him — slowly.”

    • Willys41 February 9th, 2017 at 21:34

Nah, reading it would be a waste of time. Explaining it in third grade language might actually convey something Trump could understand.

  10. majii February 9th, 2017 at 19:32

Another example of the hazards of turning the governing of the nation over to a group of extreme ideologues who can’t be bothered to read or understand the Constitution and existing federal laws. If asked by a member of the press, I’m expecting Spicer to respond that Trump “won” this case because they always win everything in that alternate universe which they inhabit.

    • Larry Schmitt February 9th, 2017 at 19:36

trump has always claimed he won the housing discrimination suit the Feds filed against him in New York back in the 80’s, even though he settled and had to pay a fine. I guess if he didn’t get convicted and go to jail, he considers it a win. I wish the government wouldn’t settle so easily. A few convictions would have more effect than a fine. They can always come up with more money.

  12. Mike February 9th, 2017 at 20:29

The best he can hope for is a 4-4 split and it’s back to square 1.
If he were a bit smarter, able to keep his mouth shut, and get along with others, he might convince congress to back him up and they could do pretty much what ever they want … maybe even a Muslim Ban if they can show cause.

    • granpa.usthai February 9th, 2017 at 20:51

1st Amendment says they ain’t got no just cause.

      • Mike February 10th, 2017 at 07:08

Constitutions can be suspended … just ask Lincoln.
On a funny note … my ex wife is a lawyer and back when we were kids in college, the Woman’s Movement in full swing, she showed me this brief (Executive Order)banning women and making it illegal to harbor them. It followed the wording Lincoln used when he suspended habeas corpus.
We used to laugh about it … not anymore…

    • Willys41 February 9th, 2017 at 21:33

You gotta hand it to the guy. He did a great job telling everybody what a racist crock of crap he really is — and the whole point of the ban is “radical islam.”

  13. Foundryman February 9th, 2017 at 20:37

So, President Bannon thought he could over step his authority and wipe his ars with the constitution, seems like a felony to me.

    • granpa.usthai February 9th, 2017 at 20:53

when they ignored the ruling of the 1st Federal Judge, they clearly showed their intent was NOT to obey the law.

trump’s whole damn administration should be thrown out.

  15. Willys41 February 9th, 2017 at 21:31

So the question is will the appeal be acted on by the Supreme Court before or after Gorsuch is seated.

    • Jack E Raynbeau February 10th, 2017 at 12:26

Hopefully after. It will be a great opportunity to see Gorsuch in action. I’m not confident that he would side with Trump* in this case.

  16. Willys41 February 9th, 2017 at 21:39

    The more significant issue:

“There is no precedent to support this claimed unreviewability, which
runs contrary to the fundamental structure of our constitutional
democracy,” the panel wrote. “Although our jurisprudence has long
counseled deference to the political branches on matters of immigration
and national security, neither the Supreme Court nor our court has ever
held that courts lack the authority to review executive action in those
arenas for compliance with the Constitution.”

The trumptard’s response— “SEE YOU IN COURT”—– will ironically one day soon in the near future—— be his karmic fate undoing. We will see him in court.

  19. bpollen February 10th, 2017 at 01:34

If it is such an imminent threat, why is the list comprised of countries who haven’t sent terrorists to the US who killed people in a terror attack?

The vast majority of jihadist terror attacks come from Americans – US born, then naturalized, then permanent resident. The top 4 foreign sources for terror killings (measured by casualties) are Saudi Arabia, UAE, Egypt, and Lebanon.

That’s like saying that ferrets are getting into the chicken coop from underneath, so let’s put a lock on the front door.
