Supreme Court overturns Texas abortion restrictions

By a 5-3 vote, the Supreme Court ruled that Texas has gone too far in limited access to abortions.

The Texas case has been seen as a crucial test of a state’s power to regulate the practice of abortion. Though states have the authority to regulate doctors and hospitals to protect the health of patients, the Supreme Court has said states may not put an “undue burden” on pregnant women who seek an abortion. This includes “unnecessary health regulations,” the court said in 1992.

At issue in the case were two stringent regulations adopted by the Texas Legislature in 2013. One required doctors who perform an abortion to have admitting privileges at a hospital within 30 miles. The state’s lawyers said the rule ensures that doctors are “qualified,” and that it “promotes continuity of care” if an emergency arises. Abortion-rights advocates said hospitals often refuse to extend privileges to these doctors because of the controversy over abortion and because very few of their patients will be admitted to a hospital.

The other disputed rule would require all abortions, even those within the first weeks of a pregnancy, be performed in a facility meeting the standards of an outpatient surgical center. The state said this would help ensure “a sterile operating environment” for surgery, but clinic directors say the extra space and equipment is costly and unneeded

    Let this be a teachable moment for any Bernie supporters who have decided to either stay home in November or file a protest vote for Jill Stein.

    We have Justice Ruth Bader Ginsburg, thanks to President Bill Clinton. If you want another Justice Ginsburg on the court, do all you can so that we have another President Clinton in the White House.

    Pouting at home or making a protest vote simply paves the way for President Trump to give us another Thomas or Scalia.

      Excellent point. That goes for all the other progressive goals we want too: Ending Citizens United, getting Universal Health Insurance, moving forward on global climate change, continue protecting women’s rights, passing an immigrant law that makes sense and providing the 1st two years of college free to name a few. We have a chance to lay the groundwork for a truly progressive government if we don’t blow it.

        If forced to give one reason to vote Democrat it would be the Supreme Court.

        Ginsberg and Kennedy are in their 80s and Bryer is not far behind. The next president will have to select at least one (for Scalia) and possibly four of the nine. Whoever he or she selects is going to be on the bench for a long time.

        Think how a Trump-stuffed court will vote on business and personal freedom issues.

      Absolutely, I honestly get annoyed (ahem, to say the least) at those who wail about their “principles”, and condemn Hillary as some kind of demonspawn, thusly enabling a Trump Presidency and putting the lives of countless thousands, maybe even millions, at risk.
      Time to grow up folks, and see the hard light of day, and figure out a realistic way to dig out of this giant hole.

    A SCOTUS with integrity, intelligence, and a respect for law is what is needed, and can only be brought about by electing Dems all across the land. The Oval Office and Congress can make monumental changes to the downward slide toward oligarchy.
    Vote like your life depends upon it, which it does, along with the lives of our children, grandchildren, and people all over the planet.

    If I remember correctly, this would have reduced abortion clinics in Texas from 21 to 10.

    If Texas had only 10 gun stores, would Texans feel that their Second Amendment rights were protected?

            If the dems in Texas were more organized it would be a blue state…the numbers are there…I seem to remember something about 38% of minorities not even being registered to vote…That’s the kinda thing I’m talking about
