Supreme Court declines to hear challenge to Colorado’s marijuana law

They’ll keep trying to stop legalization, but they’ll fail.

Solicitor General Donald B. Verrilli Jr., the federal government’s top appellate lawyer, urged the justices to refuse to hear the case.

“Nebraska and Oklahoma essentially contend,” he wrote, “that Colorado’s authorization of licensed intrastate marijuana production and distribution increases the likelihood that third parties will commit criminal offenses in Nebraska and Oklahoma by bringing marijuana purchased from licensed entities in Colorado into those states. But they do not allege that Colorado has directed or authorized any individual to transport marijuana into their territories in violation of their laws.”

Both Mr. Verrilli and Colorado officials added that Nebraska and Oklahoma could pursue their objections in a more conventional suit, filed in a federal trial court.

The Supreme Court did not explain why it declined to hear the case. Justice Clarence Thomas, joined by Justice Samuel A. Alito Jr., dissented, saying the court was required to hear it.

    We could save hundreds of thousands if not millions if we quit prosecuting cases where they list this drug as a crime and we would make millions and eventually billions in taxing it after it becomes legal. It seems pathetic that we are discussing this in 2016.

        I know, there are certain things (few and far between) I am conservative about, if I don’t have proof before me that will support an idea I am proposing, I say a number that cannot be disputed.

          The war on pot costs $10-20 billion a year when you add up cops, courts, and corrections. Then we have the added problem of militarizing the police so now they are better armed than our troops and are waging a war against their only enemy…us.

            That money could fund programs that would help our neediest citizens get the education they want in the fields we are need of for employees. Our entire country would benefit, not just a few who own these for profit prisons.

    Let them argue it out in the lower courts for a while … I’m not sure NE or OK have any real case at all…it’s all conjecture.

            I have drove across Nebraska, and Kansas a few times in my life. I always scheduled that part of the trip in the middle of the night so as not to miss anything interesting. :+)
