Report: Chicago Police Erased Surveillance Video After McDonald Shooting

Posted by | November 29, 2015 08:49 | Filed under: News Behaving Badly

The manager of a Burger King next to where Laquan McDonald was shot says police asked for the surveillance video right after the shooting.

Jay Darshane told The Chicago Tribune this week that moments after McDonald was shot multiple times, a few police officers entered Burger King and asked to see the surveillance video. He let them look over it and they left hours later.

But when the video was examined the next day, there was a missing 86 minutes of footage, which included the time of McDonald’s death.

Darshane said he testified to a federal grand jury about this months ago, and he insisted that everything was working properly, so it couldn’t have been an error.

Be careful saying that. I just said essentially, the same thing and comment is waiting to be approved. Sometimes, you just can’t tell the truth.

your comment is waiting to be approved where? here?

It already happened to me a number of times. I usually can’t figure out why…

            • Lyndia November 29th, 2015 at 21:17

Well, they posted it. It is under Allison’s post. I didn’t think I said anything wrong, I just told the truth on them AND EVERYBODY CAN SEE IT. This is Chicago Politics. It is a different type of thing in this city and it is very political. These lying dogs, got CAUGHT, RED HANDED, trying to cover up this sad situation and that is what everybody is so mad about.

              • whatthe46 November 29th, 2015 at 21:28

everyone has every right to be angry. that’s fuckin’ bull. this child was murdered in cold blood, this is not a game. this is real fricken life. mothers are losing their sons because of some sadistic racist asswipe and they are being protected from taking responsibility.

The police probably figured the crime of destroying evidence against them wasn’t as bad as the crime they actually committed. The only real way to deal with this, is to aggressively pursue this case and reform the entire police department and change the way things get done. Heads need to roll. It’s needs to be a lot easier to fire LEOs that are suspected of corruption and illegal activity within the department. All this paid leave needs to end, it just encourages bad behavior.

    • Larry Schmitt November 29th, 2015 at 09:32

But that means the prosecutor’s office isn’t already in bed with the cops, and in a lot of places they are. They’re on the same team, so in that case it’s not likely they will press the issue.

      • rg9rts November 29th, 2015 at 09:36

        Ask Eric Garner’s family

      • mea_mark November 29th, 2015 at 09:48

Prosecutors need to be held accountable for their corruption also. If prosecutors ended up in prison for not prosecuting bad cops maybe they wouldn’t be so corrupt. We are letting them get away with it. That has to stop.

        • allison1050 November 29th, 2015 at 09:56

Prosecutor Alvarez had to have known about the video. I love how the police chief has now tried to back peddle.

          • Lyndia November 29th, 2015 at 20:11

Now come on Allison, YOU KNOW Alvarez knew about the video. Rahm knew, the alderman knew, McCarthy knew, they all knew. If the judge would not have ordered the release of the video, Van Dyke and Servin, would still be sitting at their desk, drawing a pay check on the 15th and 30th of each month.

        • Lyndia November 29th, 2015 at 19:52

I have been saying that for a thousand years. The prosecutors have been getting away with murder for a long time, so have the judges.
They should be disbarred, after serving their sentences.

          • whatthe46 November 29th, 2015 at 20:10

as for charges, I say everyone who as involved with the erasure of the video needs to be charged with tampering with evidence a felony. and that includes the IT who erased the video. but, alas, the prosecutor won’t touch this. the fact that he waited for so long to charge this pos is evident he’s not going to do his job.

            • Lyndia November 29th, 2015 at 20:16

It is not a he, it is a her. Of course, the little b is not going to go after all those cops. However, I heard they have a copy of a tape, showing the cops erasing the tapes. I hope it is true. I am wondering if they could get that information form the hard drive? I am not a computer expert.

              • whatthe46 November 29th, 2015 at 20:18

thanks for the correction. hell they might erase the tape of the tape being erased.

                • Lyndia November 29th, 2015 at 20:19

You got that right. They are some snake dogs.

    • maggie November 29th, 2015 at 23:40

the witness to the destruction of the tapes should probably have federal protection…FROM the police….

      • whatthe46 November 29th, 2015 at 23:55

only if he comes clean as to what he saw and who gave him the orders. people need to learn how to grow a damn back bone.

  3. Suzanne McFly November 29th, 2015 at 10:08

Those cops who assisted in this murder should be sitting by their buddy awaiting trial.

    • Lyndia November 29th, 2015 at 19:45

YOU GOT THAT RIGHT, BUT IT WILL NEVER HAPPEN.

All he has to do, to prove tampering, is give the hard drive to an IT professional and let him do a bit-by-bit scan. Overwriting programs don’t just write “random” ones and zeroes. They follow an algorithm, which means the “random” data used to overwrite a file actually follows a pattern. An IT professional would be able to prove, or disprove, tampering.

    • whatthe46 November 29th, 2015 at 15:40

unless they used an IT tech to remove the data to the point it can’t be retrieved.

      • mea_mark November 29th, 2015 at 15:52

The material may never be recoverable but the evidence that it was removed is near impossible to cover up. You would pretty much have to destroy the whole thing.

        • whatthe46 November 29th, 2015 at 16:00

stupid people aren’t very bright. they erased only part of the video and left the remaining recordings in tact.

        • maggie November 29th, 2015 at 23:38

plus they have the witness who saw it being destroyed…..

          • whatthe46 November 30th, 2015 at 00:44

really? I know that the employee showed them the video tape at the burger king and all was fine as they viewed it together. to that extent, who are you referring to that witnessed the cops destroying the tape other than the IT that did under orders.

            • maggie November 30th, 2015 at 01:11

it was reported that there is video of him destroying the evidence by the very apparatus that he pulled the evidence from in the restaurant…so not only is the worker the witness but the video of him destroying the evidence (by taking it and then not being able to produce it) is the evidence…so the witness testimony is backed up by the camera…nice huh? (cops are stupid) ;)

              • whatthe46 November 30th, 2015 at 01:23

ok. but, here’s my question. did the employee say that they were deleting sections in front of them. the only reason why I asked is because there’s more than 80 plus mins. on the tape that was destroyed, but the remaining recordings were still there.

                • maggie November 30th, 2015 at 01:56

my recollection as reported from npr….was the report implied the restaurant worker was a witness to him “doing it” or “taking it”….the cop could have just removed the section that implicated him in the crime….

                  • whatthe46 November 30th, 2015 at 02:38

I know that’s an obvious conclusion. that is, that the “cops” removed the important minutes. what we do know from the testimony of the employer was that, they all reviewed the tape and it was in tact. so, he did witness them taking the video, but not destroying it.

      • maggie November 29th, 2015 at 23:37

they do…it’s called taking a hammer to it to “disable” it…

        • whatthe46 November 29th, 2015 at 23:42

          lol. really, that was funny.

          • maggie November 30th, 2015 at 00:33

I am glad you liked that…its true…the cops absolutely do destroy and disappear evidence …we all know it…;( as far as the “walking” goes…we need to support Loretta Lynch she is trying while under a lot of pressure…and we need to pressure the FBI more…and just keep those phone cameras on and post….to hold the executive branch’s feet to the fire…in local cities, states, and have black advocacy organizations moving to the prosecutors table and getting on the bench…before the strategy was all defense…..I think now with camera’s and social media they need to feel comfortable moving to the prosecutors table….a lot…and just don’t let up until nationally the executive branch and law enforcement branch understand their policies are not worth the paper they are written on…and when they start practicing equal rights equal protection they will keep monitoring them forever because they can’t be trusted….if they get the idea that the public, the feds, the executive agencies are going to make their lives hell every time they screw up …things will start changing….but not until then…like you say…no consequence, no accountability….now….lets take a page from MIZZOU and boycott all colorado sports….until gov takes domestic terrorism against women, health clinics and doctors seriously….;) have a great evening.

      • illinoisboy1977 November 30th, 2015 at 10:20

Whether the data can be retrieved, or not, the drive would still show evidence of targeted erasure. That’s all that would be needed, to prove tampering.

  5. FatRat November 29th, 2015 at 12:26

Jon Herb Menick spokesman for the FOP has stated that under Illinois Statute (720 ILCS 5/31-4) (from Ch. 38, par. 31-4) aka (Have It Your Way) that the subsequent removal of video footage was indeed standard SOP. /s

video is only useful when the citizen has the gun

  7. maggie November 29th, 2015 at 23:30

what is sad is that he erased the tapes …it’s not even shocking….it’s not like it hasn’t been done before….frequently….that’s how the cops control the narrative….

    • whatthe46 November 29th, 2015 at 23:54

you’re fk’n skippy. same way with Trayvon. the cops fk’d with evidence, same with Michael brown. with garner, they couldn’t manipulate the video, and they still walked. we’re fk’d.
