High School Cheerleader Banned After Anti-Immigrant Tweet

The Revere, MA high school student says she was taking a page from the Trump handbook.

 Caley Godino is a senior at Revere High School and she says part of their homework is to watch these presidential debates and her tweet was simply about a hot button issue in the headlines.

“When only 10 percent of Revere votes for mayor cause the other 90 percent isn’t legal,” Godino said in the tweet.

She says it was a response to a tweet from her teacher about the low voter turnout for November’s mayoral race. Caley says she meant her tweet as a political comment not a racial comment.

But after other students complained, the school stepped in. Revere Superintendent Dianne Kelly says the district believes in freedom of speech, but cannot support what she calls insensitive language.

“If you’re going to stand up and say something that other people will find offensive- than you need to be prepare to deal with the ramifications of that,” Kelly said.

Caley’s mother says her daughter who is the high school’s head cheerleader is now banned from cheering for the rest of the season and doesn’t think the punishment fits the crime.

Kelley said, the school did not discipline Caley because of the tweet alone. But because of student privacy, she couldn’t comment on specifics.

“I would just say that, not everything you read is a full story of what’s happening,” she said.

        If only 10% vote, it’s for the same reason as in other cities: laziness. Local elections always get lower turnout than presidential ones.

    If her high school has a mandatory civics class, I can imagine her civics teacher is hanging her/his head in shame. I taught civics in GA for over 30 years, and a part of every civics curriculum makes it very clear that non-citizens can’t vote in any U.S. election. I think her tweet indicates that she bases her opinions on feelings instead of facts. Permitting her emotions to takeover while tweeting landed her in a place where she doesn’t want to be. Maybe she’ll learn that it’s not a good idea to express all of her feelings/emotions on social media.

    If the cheerleading program is funded by the school and it is a publicly funded school, she has ABSOLUTE 1st Amendment protection. If the content of the tweet and/or other speech is the school’s only reason for punishing her, she could have a claim of action against the school district. Offensive speech is protected speech, as long as it’s not threatening or inciting.

        But, the school is a functionary of the government. Which means they can’t punish her for “offensive” speech, as long as it’s not profane, threatening or inciting. Look up the Supreme Court case law. “Students don’t lose their rights at the schoolhouse gate”. If they can punish her for her speech, they’re getting away with censorship, which violates her 1st Amendment rights.

            Unless you say, specifically, that people need to cause harm, it’s not inciting. The courts have ruled very narrowly, on what kind of speech can be considered threatening or inciting. There has to be a fine degree of specificity.

      You are quite right and this action by the school authorities is yet another piece of evidence that the leftists are as prone to censorship as the rightists. One sees that in some of the leftist commenters on this website including one “Carla” something or other who recently opined on this website that I had no “right” to express my opinion here and should go away because I was “irrelevant.” And these people consider themselves liberal!!!

    People say stupid things all the time. Just listen to the gop candidates every day. A teenager like her can be taught and I think the school missed a teaching moment. I’m more disturbed by the districts statements.

    It’s true she needs to deal with the consequences but in this case that could have been counseling, peer pressure, or sensitivity training. Punishment for free speech, even though it’s stupid speech, is not our way.

        Impulse control is not very well developed in 18-year olds. Hell, it’s not well developed in many adults. Just look at some of the posts here. (and I include myself in the occassionally too impulsive category) I’m bothered by all this talk of restricting offensive speech and punishing the speakers. What she said does not fall into the “shout fire in a crowded theater” category IMO.

      I think there is a bit of a difference when one of several students is replying to a teachers Tweet that other students will see and discuss, I am not sure that is quite the same as someone making an original tweet. In the latter it is seen by only those who cares what that person has to say. In the former it is read by those who may have an additional interest of reading others’ replies to an original post.
      Either way, Cheerleading is a privilege. Not doing what 99%+ of the other students are not doing is not punishment at par what she did not being a crime. ll of the other non-cheerleading students do not feel punished I bet

Yes it’s true that the first amendment only applies to acts by government but there is such a thing as the spirit of the first amendment which normatively should apply to opinion websites. You epitomize exactly the kind of intolerant leftist that as I wrote are mirror images of the rightists. Believe me, Ms. Akins, I have other opinions about you based on your photo but as I am not a pig like Donald Trump I certainly wouldn’t write them herein.
