Supreme Court Takes Up Case That Could Gut Roe V. Wade

Posted by | November 13, 2015 15:03 | Filed under: Politics

The case revolves around a restrictive Texas law that makes it more difficult for abortion clinics to operate.

The case focuses in part on a provision that has not yet gone into effect requiring clinics to have costly hospital-grade facilities. A separate section of the 2013 law that requires abortion clinic physicians to have admitting privileges at a hospital within 30 miles (50 km) is also at issue but has gone into effect in most parts of Texas…

The last time the nine justices of the Supreme Court decided a major abortion-related issue was in 2007 when they ruled 5-4 to uphold a federal law banning a late-term abortion procedure.

The Supreme Court legalized abortion more than four decades ago but abortion remains a contentious issue in the United States and some states have sought to chip away at a woman’s right to terminate a pregnancy.

These states have pursued restrictions including bans on certain types of abortion procedures, regulatory standards imposed on clinics and abortion doctors, waiting periods, ultrasound requirements and others.

The court will hear oral arguments in the case early next year, with a ruling due by the end of June.

Backers of the Texas law asserted that the provisions being challenged before the Supreme Court were necessary to protect the health of women.

Sounds reasonable if the law is applied equally to all medical establishments. Such as the High School nurse will be required to be an expert on Diagnostic Medicine and a minimum of three Operating Rooms. /s

How about dentists? Oral surgeons? Chiropractors?

      • Larry Schmitt November 13th, 2015 at 17:12

Chiropractors aren’t even recognized as doctors by most medical people.

        • Lyndia November 13th, 2015 at 21:27

but they are still called doctors. I have a chiropractor in my extended family.

      • whatthe46 November 13th, 2015 at 22:27

doctors who perform vacetomies? why isn’t that a hot issue with these so called “christians” that they shouldn’t be performed period?

When abortion is outlawed, only the rich will be able to afford not becoming outlaws…they’ll just fly to where it’s legal or have their gynecologist perform a D&C…wink wink…

Meanwhile those with lesser means will die or be permanently physically damaged…

    • Lyndia November 13th, 2015 at 21:25

or burden with children they don’t really want and we all know what that can lead to.

Those that can afford to, will take a week end ‘excursion’ to a freer country to have their problem taken care of.

Poor women, as people have stated more eloquently than I, will go to charlatans or DIY abortions as they did when I graduated nursing school in the mid ’50s. I, along with my fellow nurses, saw the results of what poor or even lower middle class women and girls did when they came into the ER. Some lived, and some died. All needed transfusion, and the antibiotics of that day. I do not want to see those days return and neither should anyone else, if they have half a brain.

        • maggie November 14th, 2015 at 19:48

agree….:0 and thanks for the up vote…exactly DIY….ER…it’s putting women at risk…and is expensive….

Well, what we need then is for one of these multibillionaires to step up and build clinics that meet the standards…

Women damned well better get in a royal rage over this and go apeshit on Republicans from sea to shining sea. No need to hold anything back. They need to scare the daylights out of the bastards so they think long and hard about ever trying this again.
But if Republicans get their way and women gripe for a day or two and let it die, then expect the GOP to find more ways to eliminate abortion rights, step by step.
The Democratic Party needs to win big in 2016.
To do so they are going to have to appeal to everyone who voted for Obama in 2016.

The handful of Left-wing zealots who want to create a tea party on the Left that is a mirror image of the TP we have now need to pipe down, lest they alienate moderate voters whose swing usually decide presidential elections. If the Left-wing TP-ers cause significant numbers of moderates to stay home or vote for a third party candidate, say hello to a President Cruz selecting the Supreme Court justice to replace Ruth Bader Ginzberg, changing the balance of the court for years to come.

      Justice Schlafly?

      • maggie November 13th, 2015 at 20:39

        aaacccck! let’s make sure that doesn’t happen…;)

      • burqa November 14th, 2015 at 20:44

        Or Justice Huckabee.
We have seen the damage done to our political process, the functioning of our government and our country as a whole by extremism.
Should a left-wing tea party take over the Democrats, the problems caused by the right-wing tea party will be increased.

    • maggie November 13th, 2015 at 20:36

I am all for going apeshit and scaring the daylights out of the GOP domestic terrorists from sea to shining sea…;O

      • burqa November 14th, 2015 at 20:40

When extremism is the problem, the solution is not more extremism, because the problem gets worse.
It is foolish and self-defeating to copy that which we abhor.

To go with my comment below, zealots on both sides of the political spectrum prevent progress.
Progress implies change from one thing to another that is better.
When we have hateful bigotry aimed at gays, Muslims, African Americans, Christians, Jews or immigrants, it does no good to respond in kind.
All that does is causes the other side to dig in their heels.
Just think of a time when someone convinced you to alter your opinion.
Did that happen because they were screaming obscenities at you?
        No, of course not.
In such a situation no one is amenable to persuasion.
And just what do we want, an ego pump from calling the other side names, or do we want change?
The only way to get people to alter their views is to communicate with them in a calm, respectful atmosphere. We have to be exceedingly patient and show them how unfair bigotry is, and how they object to it when their rhetoric is directed against a group they favor. It takes time, a lot of time to get even a little change, but we lose that time and delay progress when we go apeshit on them.
There are a few of keys here I think are worth keeping in mind.
One is to take the ‘do unto others’ approach to heart.
Another is we have to be patient and give the other person space to change.
As I like to say, when you’re nose to nose with someone and want them to come over to your side, the thing to do is step back and give them room to step forward.
A third thing is to stay focused on the goal.
The goal here is to reduce hatred, whether it comes from our allies or opponents. We look at the damage done by the hate and then imagine where we’d like things to be. Then we have to figure out how to get there, and the way is not through vitriol.
The way is through patience, forbearance, kindness and understanding. Humor can go a long way to breaking down barriers to make change possible.
We have to look for places where we agree and then expand that beachhead. When our opponents find us to be nice people with differing opinions they are more apt to consider what we are saying.
Treat them the way we would want to be treated.

When fire is the problem, more fire is not a solution.
The way to fight fire is with water.

….and to the above I would add that there once was a time when this site was one where discussions were held without all the vitriol seen here now.
Our arguments shined far brighter, because the nastiness just serves as a distraction and a convenient ‘out’ for those who can’t handle our arguments on the issues. Take away the nastiness and all they have left is answering our points, which they seldom can do.
They would come here and experience a culture shock when they saw how flaming was discouraged and reasoned, calm, point – counterpoint debate was encouraged.
This site was an oasis from the usual crap seen everywhere else. Some couldn’t handle it and left, while others welcomed it and stuck around.
It was really special back then to have such a forum.

Women, do you realize what the rightwing forced birth party has in mind for you?

  5. maggie November 13th, 2015 at 20:33

I think what scotus should keep in mind is the dems will continue to be in the white house and continue to make the appointments….so I don’t think that scotus is going to rule in a way that it would just get overturned in a few years…I am optimistic ….that scotus will rule for choice

  6. Lyndia November 13th, 2015 at 21:30

I don’t know why these people will not leave women and their reproductive rights alone. If you don’t believe in abortion, don’t get one and DONT STOP ANOTHER WOMAN FROM GETTING ONE. MIND YOUR OWN BUSINESS.

    • NIGHTWATCH ABCP ........ November 13th, 2015 at 22:14

You ask the question WHY ??? It’s because these Evangelical Christian TALIBAN don’t WANT (POOR) women to have the “FREEDOM to CHOOSE” !!!! But be they RICH, well THAT’S a different story. If Roe v. Wade is gutted, ONLY the rich will be able to get abortions !!!! The POOR — FORNICATE THEM !!! So sayeth THEIR Lord and God …………
