Tennessee Judge Won’t Grant Straight Divorce Because Of Gay Marriage

Posted by | September 8, 2015 07:00 | Filed under: News Behaving Badly Politics

Hamilton County Judge Jeffrey Atherton has some twisted logic.

“The conclusion reached by this Court is that Tennesseans have been deemed by the U.S. Supreme Court to be incompetent to define and address such keystone/central institutions such as marriage, and, thereby, at minimum, contested divorces,” Atherton said.

Apparently, Atherton does not understand the word ‘marriage’ nor does he care to and is using his bigotry to deny the couple a divorce.

Well a divorce would be when a married couple no longer wishes to remain married. There, did we clear that up for him?

The couple — Thomas Bumgardner, 65, and his wife, Pamela, 61 — were married in November 2002 and had no children together during that time. The couple filed for divorce in September 2014, citing irreconcilable differences, according to Times Free Press.

“I don’t know for sure,” said attorney Mike Richardson, “but I suspect the U.S. Supreme Court did not intend to preempt divorce law.”

See, all those people were right, gay marriage has ruined everything. No, wait, it’s one idiot judge doing that. Gay marriage has nothing to do with this.

He should be reported for judicial misconduct.

Well… A judge isn’t required to grant a divorce. He’s only required to hear the petition and make a decision. Technically, he’s only guilty of misconduct if he subverts the law to inequitably assign financial gain or criminal sanction. Refusal to dissolve a marriage is completely the judge’s prerogative. Still, he’s being a tool.
