Davis Attorney: State Should Just Take Her Name Off Marriage Licenses

Mat Staver of the Liberty Council appeared on radio with me Thursday night saying all Kentucky has to do is take her name off marriage licenses and the problem will be solved. In the meantime, his client is in jail.

I asked Staver about his statement comparing his client to a Jew in Nazi Germany:

“Does that mean that if you’re Christian, don’t apply here; if you’re a Jew, you gotta get — what happened in Nazi Germany, what happened there first, they removed the Jews from government public employment, then they stopped patronizing them in their private businesses, then they continued to stigmatize them, then they were the ‘problems,’ then they killed them,” Staver said. “The fact of the matter is, she has a right to this employment and you don’t lose your constitutional liberties just because you are employed by the government.”

But Staver denied he was comparing Davis to Jews in Hitler’s Germany.

COLMES: Are you comparing your client to a Jew in Nazi Germany? That’s what it sounds like. STAVER: No, but what I’m saying is that here, if she were to just simply resign, this is what happened to the Jews. If you’re a Jew, you’ve got to get out of public employment.

COLMES: Do you really think it’s appropriate to compare this to Jews in Nazi Germany?

STAVER: No, I’m not comparing it to a Jew, but what I’m saying is because of somebody’s faith or somebody’s ethnicity, you can’t just simply say you have to leave employment. In this particular case, we’ve got the a Constitutional Amendment of the US Constitution, you’ve got the Kentucky Constitution, the Kentucky Religious Freedom Restoration Act that says we cherish religious freedom and the rights of conscience. Let’s try to see if there is a way to accommodate it rather than run them out of public employment or private employment.

      what about the previous paychecks she received while (by her own admission) knowing she would not perform her SWORN DUTIES any damn way?

      appears to be a bit of intent to commit FRAUD at PUBLIC EXPENSE to me.

        Definitely some kind of legal action should be taken against her. The lawyers will love it and the press will have no end of things to write. Is there re-call legislation in KY? A petition should be started now, so that it’s ready when the legal wheels start turning.

    Too late lawyer guy…you probably told her that she wouldn’t be jailed and at worst she would be fined but her believers would pick up the tab. Now you come up with this half baked idea…well one way to take her name off the documents is for her to resign. Got that genius? No charge for the consultation.

    Shoulda guessed from the name. The Liberty Council has a close relationship with Liberty “University.” How hard does the judge have to work to keep from laughing when Staver shows up in court?

      usually what happens in contempt cases – prevents mayhem in the court system in general (people will be less likely to openly defy a legal court ruling) and there’s really no reason for a bond hearing as they’re not being charged with an actual criminal act.

      Why waste taxpayer money keeping her in jail. I say fire her ass. If she refuses to do her job, they should just terminate her employment and get a job at McDonalds. Let’s see if they’ll put up with her bullsh*t.

        They can’t fire her. She is an elected official. She cannot be impeached either until the Legislature is in session, which will not be until January 2016.

            Worse. They generally have to pay for her legal defense since she is being sued in her official capacity. And since Gov. Bashear rightfully will not waste hundreds of thousands of dollars on a special legislative session that means that she will continue to get a paycheck. Additionally, a significant number of Republican legislators are behind her, which means that impeachment is unlikely. Which means that she will continue to draw a paycheck until the next election.

    It is easy, resign. If you can’t do your job, you should take it upon yourself to leave, that is the respectable thing to do. This “Christian” family will need to find another job, but it won’t pay nearly as well. Greed is one of the 7 deadly sins, you would think they know that.

    duly charge her with:

    EXTORTION (preventing her staff from doing their SWORN DUTIES due to her ‘personal religious belief’ at TAXPAYER EXPENSE)

    MALFEASANCE IN OFFICE (for refusing to do her SWORN DUTIES and PREVENTING her staff from doing their SWORN DUTIES due to her ‘personal religious belief’ at TAXPAYER EXPENSE)

    FRAUD (for her continued acceptance of her taxpayer funded ‘paycheck’ while knowingly and willfully refusing to carry out her SWORN DUTIES due to her ‘personal religious belief’)

    …maybe throw in PUBLIC NUISANCE (just as a filler)

    I wonder if anybody can explain this to me. Why, in this day and age, are we actually entertaining anything anybody says about what their imaginary god likes and dislikes?
    If this woman thinks gay marriage is against her beliefs, she should quit her job and find something that more closely resembles what Zeus approves of. How dare she impose her crap on all of us!

      This lady has been divorced 4 times. Divorce is specifically proscribed in the Bible. Deuteronomy and Leviticus give instances where it is OK to kill people. Leviticus proscribes the eating of shellfish and wearing clothes made from more than one material. I am willing to bet that Mrs. Davis doesn’t adhere to these (and many other) passages.

        That’s because they cherry-pick which parts of the bible they wish to adhere to. In her case, she’s decided that God was just joking about divorce, eating shellfish and wearing mixed fibers – but NOT gay marriage!

      She can’t be fired. She’s an elected official and would need to be impeached by the Kentucky legislature but it’s not even in session right now. Besides, what do you figure the odds are of the Kentucky legislature impeaching her?

    He wasn’t comparing Kim Davis’ situation to that of Jews living in Nazi Germany, he was just saying her position is more or less the same as that of Jews in Nazi Germany.
    There’s a difference…. Maybe?
