Napolitano: Obama Committed War Crime

Judge Andrew Napolitano condemned President Obama for the drone strike that killed Americans, saying  “The president cannot summarily kill [Americans]. That’s a war crime!”

The Obama administration announced yesterday that it had accidentally killed an American doctor and an Italian aid worker, both held prisoner by al Qaeda, during a drone strike. But though the administration apologized profusely, Judge Andrew Napolitano interpreted their actions as wholly unconstitutional.

“I condemn, in words as strong as anyone can muster, the idea that the president of the United States can be judge, jury and executioner for any American,” he said during an appearance yesterday on Special Report with Bret Baier. “The Constitution expressly prohibits it, and we fought every single war against tyrants so that that type of unilateral power in the hands of one person, who now apparently delegates it to others, would ever come here.”

    The hostages were not executed. The best intelligence we had access to indicated they would not be there. This guy is a fool.

      He was a judge for all of 8 years. I don’t see why that entitles him to be referred to as judge for the rest of his life. I was an NCO in the Air Force for almost 20 years, and I don’t call myself sergeant.

    Napalitano is grandstanding on this one that was clearly a case of bad intelligence and an unfortunate accident. That being said, IMO the POTUS is on very shakey ground concerning the execution of other American citizens in the war on terror. Napalitano’s outrage was nowhere to be seen or heard when he thought the dead were guilty.

        Fair enough, but that obscure venue on c-span doesn’t get the exposure he gets on faux. He was much less vocal over the recent drone-strikes on Americans.

      Actually, Judge Napolitano has been a VERY vocal critic of the Bush Administration’s policies. He criticized President Bush’s decisions, at the time he was making them.

    This is a different situation from the killing of the “American Al Qaeda” and his son. The “American Al Qaeda” was targeted. That is a war crime and a violation of an American citizen’s 5th Amendment right to due process. The killing of the hostages, while tragic, was inadvertent. The hostages were collateral damage, which while unfortunate, is an accepted consequence of battlefield operations. Notice, I didn’t say “acceptable”. No loss of innocent life is “acceptable”, from an ethical or moral point of view. But, from a legal point of view, collateral damage IS expected and accepted.
