Supreme Court Rejects Effort To Ban Gay Marriage In Alabama

In a rebuke to Alabama Chief Justice Roy Moore, the Supreme Court Monday has cleared the way for gay marriage in Alabama.

In a 7-2 order, the justices rejected Alabama’s bid to stop a federal trial judge’s legalization order from taking effect Monday. The state now will become the 37th where gays can marry. Justices Antonin Scalia and Clarence Thomas dissented.

The rebuff brings gay marriage to a state whose chief justice, Roy Moore, has told officials not to comply.

The Alabama request was the first to reach the high court since its Jan. 16 decision to take up the issue. Previously, the justices had let gay marriage start in Idaho, Alaska and Florida.

Each new state magnifies the potential complications should the high court rule against marriage rights. A ruling potentially would nullify lower court decisions that have required states to issue licenses, creating uncertainty about the rights of people who wed in the interim.

Dissenting were Justice Antonin Scalia and Clarence Thomas.

    That didn’t take long…I wonder which two Justice’s decided a State judge could over rule the Supremacy Clause of the Constitution..?? I have $5 on Scalia and Thomas.

        For retiring? I don’t know. Maybe old age, dementia. Let’s face it, Scalia and Thomas have long outlived their usefulness. It’s about time they’re put out to pasture.

          No, for voting against equality. Their obvious theocratic mindset and their loyalty to the church and koch should be grounds for impeachment

            That’s the problem. They’re letting their religious beliefs dictate protocol in this country. IMO, they should be impeached, but if we can’t get Bush, Cheney & company impeached for war crimes and crimes against humanity, it’s going to be twice as hard to impeach these two clowns.

            It’s a pretty sad state of affairs when we impeach a president for lying about a BJ, but give a pass to a president who started an unnecessary war and tortured detainees.
