      Because he amended the statement in his final instructions. Of course for the last 90 days they had been hearing the “evidence” with the incorrect instructions in mind. Technically it doesn’t have to be vacated, the prosecutor could file charges regardless – eye roll – but there’s not a chance in hell he didn’t know going in about TN v Garner. I live in MO and I’m not a lawyer and I know about TN v Garner. They should bring McCullough up ion charges of prosecutorial misconduct, but I think he did just enough to get away with his behavior.

    :) I’m not fully understanding why the gj’s decision was not vacated when it’s been shown that mcculloch gave instructions based on a law that was ruled unconstitutional in 1985.

    If I was them, I’d be doing more than just considering a lawsuit after that kangaroo court charade.
    I hope the bar association goes after prosecutor McCullough as well.

    Of course, why am I not surprised. Now, all those business owners whose livelihoods were destroyed should sue the individual protestors and various leftwing anarchist groups who caused all the mayhem.

      A civil suit is often the only way to get justice when the power structure is designed to impede it.

      The business owners are also free to file, in addition to the criminal charges already filed.

    DW should be sued for some if not all of that half a million dollars that has been donated to him. Hopefully he loses everything and hopefully the Feds bring him to trial and he loses that also. DW needs to pay the piper and suffer like he deserves..
