It was a 5-4 decision, with Chief Justice John Roberts joining the court’s left flank, and avoiding a thorny issue by declaring the mandate a tax.
The decision allows Roberts — whose legacy will depend in large part on this case — to avoid the severe reprecussions that both sides of the case had feared. The court did not strike down the signature domestic acheivement of a sitting president, nor did it give its approval to an expansion of Congress’ powers to regulate commerce.Click here for reuse options!
