Rick Santorum Gets Schooled By Rachel Maddow On American Civics

When I sat down to watch “The Rachel Maddow Show” last night and saw that 2016 GOP Presidential candidate Rick Santorum was one of her guests, I knew this was going to be an episode I would never forget, and was I ever right.

Santorum told Maddow that he had missed a U2 concert in New York City that evening so he could appear on her show, and when it was all over with, I’m betting he wished he had been rocking out to the boys from Ireland instead of attempting to debate American civics with someone as astute as Rachel Maddow.

The conversation turned to the recent Supreme Court decision legalizing same-sex marriage, and that’s where Santorum showed his ignorance of how our system of government works under the Constitution. Congress, Santorum insisted, can override anything the Supreme Court rules:

    Wow, it’s bad enough there’s a senator who doesn’t know the basics of how the government works, but he wants to be president? And he doesn’t know what checks and balances means? It boggles the mind.

      Rachel said “If there is a question as to the constitutionality of a law, it gets adjudicated. And the second syllable of that word means that it is decided in the judiciary. The Supreme Court decides whether or not a law is constitutional. So you could not now pass a law that bans same-sex marriage.”
      That bit about the second syllable boggled Rick’s mind.

          And there will be plenty of odoriferous stuff yet to come from this campaign. Hard to believe there’s still a year and a half to go. We’ll all be watching much less TV, just to avoid all the campaign ads. So maybe some good will come from it after all.

    The sad and somewhat scary aspect of this story is that Santorum is not unique in his twisted perception of the role of the SCOTUS in our society.
    To paraphrase a famous line from “Pirates of the Caribbean”, a number of socially-conservative politicos regard the rulings of the SCOTUS as not so much rulings as “guidelines”.

    In one respect, Ol’ Frothy is correct. Congess CAN pass any stupid piece of shite bill they want. But he is flat-out wrong on the Constitutionality question. The SC is the final arbiter; the Black Robe 9 decide what is Constitutional.

    You liberals do realize of course that the Congress does indeed have the power to eliminate the Supreme Court entirely, right? Or that the several states gathered together in a convention can do the same? Or to change a ruling of the Supreme Court through the Amendment process? So in a sense, Santorum is right and Maddow is wrong. All this might take awhile, but it can be done, per Article V of the US Constitution. And in Article II Section 4 the Supreme Court Justices can also be impeached.

      They can’t pass a law that would do so, they would have to propose an amendment and since the SCOTUS is very much conservative they won’t try that until a majority of sane justices are seated. If you want to discuss unconstitutional, start with Hobby Lobby and Citizen’s United. They didn’t even rule on the case as presented, but changed the whole thing to enable them to allow the crookedest people in the country to buy the politicians.

        You’re on a roll today JT! The wahoos may not be gods but they do have the last word on Constitutionality, not the Congress. No, Congress cannot pass a law eliminating the SCOTUS, although you’re right that constitutional convention could, assuming such a crazy amendment was ratified. The Founders made that hurdle exceedingly high for a reason. Whether you agree or not, such as with Dred Scott, their rulings are the law of the land until overturned by another SCOTUS.
