FreakOutNation: Grand Juror Sues Prosecutor Because Of Darren Wilson Case

Anomaly cites a story on St. Louis Public Radio that reports that grant juror is suing  because he believes the prosecutor mischaracterized the case. The grand juror is identified only as “Doe.”

McCulloch released evidence presented to the grand jury and publicly discussed the case after the grand jury decided not to indict Wilson, then a Ferguson police officer, in the shooting death of Michael Brown, an 18-year-old African-American.

“In [the grand juror]’s view, the current information available about the grand jurors’ views is not entirely accurate — especially the implication that all grand jurors believed that there was no support for any charges,” the lawsuit says. “Moreover, the public characterization of the grand jurors’ view of witnesses and evidence does not accord with [Doe]’s own.”

“From [the grand juror]’s perspective, the investigation of Wilson had a stronger focus on the victim than in other cases presented to the grand jury,” the lawsuit states. Doe also believes the legal standards were conveyed in a “muddled” and “untimely” manner to the grand jury.

In the lawsuit filed Monday in federal court, the American Civil Liberties Union of Missouri argues that this case is unique and that the usual reasons for requiring the jurors to maintain secrecy should not apply.

McCulloch has done several interviews since the grand jury decision was announced on Nov. 24, but the grand jurors have been prohibited from speaking about the case. The county prosecutor admits that some of the witnesses were lying, but said the grand jurors were aware.

The 12 people who could say for sure are currently sworn to secrecy.

    No one, and I mean no one – in the world – thinks McCullough did his job here. The truly stunning thing is that he thought he could pull this bullshit with the entire world watching.

      It just shows how he felt about the case he presented, he actually felt he did his job. He had no problem being the defense attorney for a crappy officer instead doing the job of prosecutor like his title would suggest.

        he DID do his job. he wanted a murderer to get “off” and he succeded. NOW will the sh’t hit the damn fan! prosecute him, strip him of his license, and re-present this to the GJ with an AG worthy of prosecuting with no bias at ALL!

          If a new AG is assigned to prosecute this case, it should go straight to trial and skip the GJ.

      Though I believe Wilson would have been found not guilty had the case gone to trial, I do agree with your statement.

    “…unique and that the usual reasons for requiring the jurors to maintain secrecy should not apply.” i agree. what angers me even most, as its been mentioned again, is that, this p.o.s. stated he “knew” that the witnesses he put up were lying. there better be reprecutions and the GJ needs to be NO MORE!
