Teacher Charged With Felony Institutional Sexual Assault, Even Though Adults Consented
Leiseth, 26, worked as a substitute English teacher in the New Brighton School District, northwest of Pittsburgh. The victims in the case were both taught by Leiseth, although the alleged sex acts occurred after classes had ended for the year.
Police launched an investigation in late May after they received tips that the teacher had sent nude photos to each of the young men.
“[Investigators] followed up on that rumor and they found those students, and they found the nude photographs, and they identified the teacher,” Moon Township Police Chief Leo McCarthy told CBS Pittsburgh.
In interviews with police, each victim described how he had been invited to Leiseth’s house, was offered beer, and then engaged in sexual activity with the teacher. The first student came over on the last day of school, in the hours following the end of classes. The second student said he visited Leiseth’s home the next day, according to police.
Leiseth lost her job in the wake of the allegations, but her attorney argued that since classes were over when the alleged acts occurred, she wasn’t their teacher anymore.
School was out. Three adults consented. Right or wrong?

18 makes them able to consent. This case should be dismissed.

While not wrong as school was out and her former students were 18, it was poor judgement by the teacher. Bianca is right, the case should be dismissed.

Poor judgement on her behalf. When I saw this article on my timeline this morning, it was kind of like WTF???? But if every person involved is 18 and older. then you have nothing but sex amongst consenting adults. Case dismissed and move forward. Nothing more to see here folks, except for the teacher looking for a new job..

If both were over 18 at the time of the contact (not just at the time of the discovery of the photos) then there’s nothing to see here. Not sure why they hadn’t graduated if the school year was over — was graduation ceremony on the near horizon, were these students held back, or did their birthdays just happen to fall so that they’d spend seniors as 18 year olds?
I had a teacher in high school who everyone knew was dating one of the students. It was obvious. He even spent time at her parents’ house. After her graduation, they got married.

Eww.However not illegal, and I can’t believe it would hold up in any court – firing her, that was a good decision.
R.J. Carter July 15th, 2014 at 14:03
Of course, firing is going to force the school board to have to get into the icky language of codifying when it’s okay to fuck an 18 year old. Is it okay if they weren’t your student? Is it okay if they’re 19 and were your student over a year ago? The teachers’ union will have some fun putting this into contracts.
Carla Akins July 15th, 2014 at 17:18
I’m sure there is some kind of morals clause. Sending naughty pics, sleeping with a student – even if they are the age of consent would be sufficient reason to fire.

Taking pictures was the dumbest part.

“…was offered beer…”
Now, this they could charge her with.

Only if it were the crappy national brands. I mean com’on, Budweiser and sex sounds more like a trailer park tryst than a learning experience.

nothing happened, two consenting adults..I can’t even figure out why they bothered to pull her in for questions…charge her, with what? Have we digressed back to the Salem witch hunts already? Are the 18 year old men pressing charges of rape? Idiots, can’t find real criminals so they are now fabricating criminals to feed the system with…it is extortion and the court system needs to be held accountable for false imprisonment every single time this happens. To drag in innocent people and make up charges to funnel victims money into…extortion …using laws made to protect children to extort from law abiding citizens…horrible.

I guess the case does depend upon at what point did Ms. Leiseth cease to be their teacher under law. She did serve alcohol to minors. She also showed appalling judgement.

They were still both adults, this is crazy!
Deirdre Hebert July 15th, 2014 at 18:31
Firstly, she gave the minors beer, and then had sex with them. So, yeah, it’s a crime.
Secondly, while she argues that “she wasn’t their teacher anymore”, the point is that she used her relationship as a teacher to facilitate this act.
Tommy6860 July 15th, 2014 at 19:21
The alcohol is one thing, but how is it a crime to have sex with someone who is by law and of legal age, an adult?
Rusty Shackleford July 16th, 2014 at 00:30
Power imbalances are a tricky thing like that. Same reason why it’s sketchy as hell for your boss to sleep with you.
