Romney Campaign Says Non-Compliance Fee Is A Penalty, Not A Tax

Mitt Romney’s senior adviser Eric Fehrnstrom says the fee for not participating in the individual mandate is a penalty, not a tax.

“The governor disagreed with the ruling of the court,” Fehrnstrom said. “He agreed with the dissent that was written by Justice [Antonin] Scalia, which very clearly stated that the mandate was not a tax.”

But Romney himself called his own individual mandate fee a tax, not a penalty.
