ICE Agent To Homeowners: “The Warrant Is Coming Out Of My Balls”

Two armed Immigration and Customs Enforcement Agents broke into the Nashville home of Angel Enrique and Jesus Antonio last year, breaking a window and shouting racial slurs.

Did they even have a warrant, Enrique and Antonio asked? “The warrant,” one agent told them, “is coming out of my balls.” So… no.

The ACLU and its Tennessee branch are filing suit against ICE on behalf of Enrique, Antonio, and the other 13 residents of their apartment complex whose rights were allegedly violated by the agents.

We don’t need a warrant, we’re ICE.”

The Fourth Amendment strictly prohibits warrantless intrusions into private homes and the Constitution’s protections apply to both citizens and non-citizens alike. In the absence of a judicially authorized warrant, there must be voluntary and knowing consent; ICE officers forcing themselves into someone’s home does not constitute consent.
