Texas Judge Says Gay Marriage Ban Violates Constitution

The ruling by District Judge Tena Callahan (right) clears the way for two Texas men to get a divorce.  Callahan says the court “has jurisdiction to hear a suit for divorce filed by persons legally married in another jurisdiction,” and that banning gays from marriage violates equal protection under the law.


Texas Attorney General Greg Abbott, Governor Rick Perry, and likely Perry challenger Kay Bailey Hutchison all side against the right of gays to get married, and seem to have problems with two people of the same sex legally loving each other.
