Gay Marriage Ban Remains In Idaho Constitution

Idaho isn’t moving to remove a ban on gay marriage that is unconstitutional.

…removing the language will likely be an uphill battle. Amending the Idaho Constitution first requires approval from the Republican-dominated Legislature. The proposal must then win a simple majority in a voter referendum -a tough task for even lesser politically-charged initiatives.

Idaho is one of 30 states that amended their constitutions to ban gay marriage that have not yet take steps to repeal their amendments, even though they have been rendered unenforceable by the Supreme Court’s gay-marriage decision.

“It might be difficult to remove the language, but it’s the right thing to do,” said Leo Morales, acting executive director of the American Civil Liberties Union of Idaho. “Lawmakers have sworn an oath to uphold the law. It makes sense to clean up the books.”

Idaho’s gay marriage ban has been enshrined in the state constitution since 2006 after winning 63 percent of the vote.

    If I were a LGBT living in Idaho I’d be thinking of leaving and taking my money with me.

      There’s no reason for them to leave. The Supreme Court has ruled that article unenforceable. If the state continues to deny gay couples the right to marry, the couples will be due a BIG payday when they win their federal Civil Rights lawsuit.

          I know what you mean. I’m preparing to move out of Illinois, myself. I’m tired of my elected officials being sent to prison, because they can’t seem to figure out that our donations aren’t for vacations and fur coats. :-)

      Good point. There are lots of gay dollars and gay friendly dollars that should be removed from their economy.

      Most folks living and working in Idaho don’t have enough money to buy the gas to leave. Low wages and high taxes on the working class pretty much keeps things in check. When you control the vote counting machines, you control the elections.

    At this point, a vote to remove the language is kind of moot, since it’s unenforceable. I’m sure there are higher priorities than cleaning out “dead” articles from a state Constitution.

      Of coarse, they are constantly under pressure to come up with new ways to shift the Tax Burden from the wealthy to the working class and they have done that so many ways now that it takes some special conniving to make to new ways to do it.

        It’s pretty much a non-issue. If the language isn’t enforceable, it’s not hurting anyone. If they want to remove it for the sake of efficiency, that’s cool. But, the reason shouldn’t just be because someone is “offended” by it.

    This Supreme Court ruling was just handed down. Idaho’s legislature does not meet again until next Jan. But, just because it is on the books does not mean it is Constitutional or Enforceable. Of coarse the Idaho gathering of Idiots will ignore, resist, and fight against any changes that might reflect having any intelligence.
