Holder Could Dismantle Ferguson PD

The attorney general hasn’t ruled out totally restructuring the Ferguson Police Department.

The Justice Department released its report this week on how the Ferguson police not only targeted black people in significantly disproportionate numbers, but they did so for revenue-raising purposes.

Holder told reporters today that reforming them “means everything from working with them to, you know, coming up with an entirely new structure.”

When asked if that includes “dismantling the police force,” Holder said, “If that’s what’s necessary, we’re prepared to do that.”

    From what I’ve read so far, the po-lice department there needs a housecleaning, that’s for sure.
    But it’s not like they can fire everyone and start all over and let the citizens live in anarchy, waiting for the new department to get underway and for the new fuzz to become familiar with the town.
    We’ve already seen what happens there when there’s anarchy and we also saw it in Iraq when authority was removed with nothing to fill in the vacuum.

      America really needs a generic police force that can move in quickly into an area and replace the current police department if a tragedy were to happen. It could be used in situations like this as well as situations where an entire police department may be taken out by terrorist or natural disaster. And I don’t mean military police but a force with great communication skills and an ability to relate to the community in a superior way. A team that could establish confidence with the community they are there to police while a new police department is formed.

    Eric Holder has no business doing anything to a local police department. Local policing is not an enumerated power of the Federal Government and has no jurisdiction here. To the liberals who are applauding this action I say sooner or later a Republican Administration will hold power and do you want them controlling YOUR local police department? This is once again Federal power run amok!

      Sorry to break it to you, but upholding of the constitution is, in effect, an enumerated power. The Ferguson PD has quite resoundingly broken the Fourteenth Amendment (specifically, the Equal Protection Clause), and local governments get their power from the state, which the Equal Protection Clause applies to. As such, the Federal Government is within its jurisdiction to deal with the issue if lower levels of government fail to do so.

      And in no way is the Federal Government suggesting “controlling” the PD. They’re suggesting a restructuring, which isn’t about control, but about cutting out corruption.

      Are you going to claim that the Ferguson PD has the right to be blatantly corrupt and kill and abuse American citizens? Or is your claim that the State of Missouri has the right to ignore (and therefore condone) corruption and racism without any federal recourse for those affected?

        There you go with the catch all 14th Amendment again. I wish you would bring that up when it comes to our failed tax system.

        And a “restructuring” means abiding by the Federal dictate. So much for local control. It’s all part of the Obama Manifesto, point number 35 located on page 113 paragraph 6 which says: “Exploit local incidents by criminal minorities, even where none exists so that Federal intervention can be used. It does not matter if law enforcement personal have acted lawfully and been exonerated. Exploit, exploit, exploit!”

If you cannot comply with that request, we can justifiably believe that every pixel making up every letter you post is not credible. C’mon, spud, show us just how right you are!

          John, you demonstrate an ability to write, but how are you at thinking while READING. I suggest that you read the two DOJ reports. Neither the report on the Ferguson Police Department nor the one presenting DOJ findings concluding an absence of any vioiation of Brown’s civil rights by Wilson contain content that justifies your position or anything that you have written. Perhaps we live in parallel universes, your’s in which individual desires and freedom to act are threatened by an evil federal big brother, and mine, one in which man’s propensity to do evil, or to be both racist and unconcerned with the primary directive of ‘To Protect and Serve’ as in this case, can be reduced, even if in small measure, by the existence of both State and Federal governments. Checks and Balances come to mind, even if unintended.

      Wrong again. No matter what the fat drug addict on the radio told you, Congress has granted the DOJ authority to investigate police departments.

      Investigating civil rights violations is actually one the their jobs. Their investigations and audits of police departments is a fairly routine event. Normally they complete their investigation, leave a report with recommendations and then they leave.

      Congress granted authority in 1994 for the department’s Civil Rights Division to investigate complaints of recurring civil-rights violations by police departments around the nation. Remember that era? Right after Rodney King?

      As a result of the 1994 law, the Justice Department also has looked into more than 20 other cities’ police departments, including Cincinnati, Los Angeles, Detroit, and — recently — Ferguson, Missouri

      Congress granted the DOJ that authority in 1994. (history is fun huh Skippy)..BUT
      you are JUST NOW, outraged because
      (wait for it).
      The DOJ found a police department that was lousy with racism and misconduct.
      Color me surprised.

        No misconduct on the part of officer Wilson, yet a few racist e-mails are used to justify a Federal takeover. No, the real problem with those small towns around St. Louis is that they get much of their operating revenue from fines levied on motorists.

          Lets start from the beginning Skippy. I’ll type extra slow.

          The DOJ is not prosecuting Wilson. The burden of proof for a hate crime/civil rights violation is pretty high. Again. The DOJ isn’t prosecuting Wilson

          The DOJ found a lot of racism, and improprieties.

          In summer 2012, for example, one officer charged a man with violating Ferguson’s municipal code by saying his name was “Mike” instead of “Michael.”

          We have a law like that here. “Failure to give correct name and date of birth to a police officer”, but guess what? Gad I ever done something like what THAT cop did, I would have been fired and decertified.

          The Justice Department also disclosed several emails sent by current Ferguson officials over the past several years that reveal racial bias. One email depicted President Barack Obama as a chimpanzee. Another email described a man who wanted to get welfare for his dogs because they were “mixed in color, unemployed, lazy, can’t speak English and have no frigging clue who their Daddies are.” A third email included a photo depicting bare-chested dancing women with the caption “Michelle Obama’s High School Reunion,” while another email included jokes about
          Muslims.
          But SUDDENLY you guys are all about the proper use of “Gub-mint” e-mails.

          Officers used a dog to attack an unarmed 14-year-old black boy and then struck him while he was lying on the ground, all while he was waiting for his friends in an abandoned house. The report concludes that in every dog bite incident reported, the person bitten was black

          and yes, the department does seem to use motorists as their source of revenue. This can be easily fixed.

          In my state, the municipality doesn’t get revenue from motor vehicle violations. The money goes into the judicial fund to pay for the courts. In fact it cost money to write tickets so we were always careful about it. Also, if a DA and judge notice an officer clogging up the court system with BS tickets, your career can go south pretty fast.
