Curfew ‘Unconstitutional’

Three civil rights groups say the curfew imposed by Missouri Governor Jay Nixon in Ferguson is unconstitutional.

Amid another night of unrest on Sunday, the American Civil Liberties Union, Lawyers’ Committee For Civil Rights Under Law and NAACP Legal Defense fund released a joint statement decrying “the suspension of constitutional rights in Ferguson” for civilians.

“Even more troubling is the unclear nature of the Governor’s order suspending constitutional rights in Ferguson,” the groups said. “People have a right to know when and where their conduct is lawful under all circumstances, but especially when the government is restricting activities that are protected by the First Amendment.”

They added: “Any order restricting constitutional rights must clearly communicate to the public when and where it will apply, articulate valid justifications for the restrictions, and provide ample alternative locations where people may gather to express their views on the important issues being discussed in Ferguson. The current executive order falls short of these requirements.”

    So just as Fox News uses every single world event to wrongly blame Obama and stoke the Obama-hating Tea Party, this site does sort of the same with this event. freakoutnation.com was a much better format and had a more objectiveness. This site seems to have the same method of operation as the many of the Tea-publican sites. Except for the sides being polar opposite of course. I have enjoyed the calling out of Tea-publicans and their absurdness, but on the issue of Ferguson you guys have been totally one sided and seem to ignore the chaos that the rioters (not protesters) are creating. Now go ahead and delete my comment and ban me. I’ll continue on my search for a true, objective outlet; if there is such a thing.

      Your comment won’t be deleted nor are you banned. You disagree with the 3 civil rights groups and that’s fine, but don’t blame this site because we aren’t on your side on this issue. We state our opinion and that’s what left wing or left wing sites do.

          You are confusing this site with The Daily Banter or confusing propaganda with opinion. I have yet to have read any DNC talking points posted here as if they were news. That is propaganda.

      The Authorities should be dealing with the rioters and looters and letting the protesters protest. They aren’t. They seem to want to treat everyone like criminals they don’t like. The FPD hasn’t been doing its job right since this started.

      You are ignoring the fact that the rioters are reacting to overbearing police tactics. They impose a curfew and everything is fine up to the curfew time. At curfew time, the police come out with smoke and teargas, tell the media to shutdown and get out and proceed to confront those who will not bend to their demands. You obviously cannot see whats wrong with the police, you only see blacks rioting.

      “What is the truth,” Pilot asked and didn’t wait for an answer. We all have truths. Are some truths less valid than others? If you are looking for true objectivity then the place to look is everywhere. The coverage on one website or one media outlet is never going to give you a whole picture.
      I have been openly critical of LL on several occasions (including the coverage of Ferguson), but not for lack of objectivity. It is a place for opinions. It is a place for individual truths. The old FON slogan of “we inform you decide,” always struck me as true because the point of the articles was not to create class of people repeating back talking points but to put the writer’s version of the truth out and allow the reader to respond with their own truths. It is why it has long been my favorite place for political conversation on the internet.

      Fact is laws can be amended, the right to protest was summarily suspended.

      if a curfew didn’t exist in the ferguson law books prior to the riots ? not only is it unconstitutional its unlawful to impose one. That’s why they now have the national guard patrolling the streets after midnight.

    “Articulate valid justifications for the restrictions,” yeah that’s gonna be a big hang up for anything the government does these days because articulating isn’t it’s strong suit.
