Gov. Pawlenty’s Request To Challenge Constitutionality Of Health Reform: DENIED
Even though President Obama’s health care reform policy has been law for more than a week now, another win was scored in its favor when Minnesota Attorney General Lori Swanson (D) shot down Gov. Tim Pawlenty’s request to challenge its constitutionality. To add insult to Pawlenty’s defeat, Swanson’s response will include the filing of a friend-of-the-court brief supporting the federal government. Swanson defended the new law in a formal letter to Gov. Pawlenty:
Having carefully reviewed the applicable Supreme Court precedent and other legal authority, it is my legal opinion that health care – which comprises over one-sixth of our country’s economy – substantially affects interstate commerce.
Despite this “setback,” Governor Pawlenty vows to continue fighting.
